Alito told members of the Senate Judiciary Committee in Washington that his 1985 memo saying Roe was wrongly decided was a “true expression of my views” as a Justice Department lawyer. Even so, Alito said the high court’s repeated reaffirming of the 1973 decision strengthened it as a legal precedent.

“I would approach the question with an open mind” if the court decided to review the precedent, Alito told Specter.

Asked whether courts should respect precedents such as Roe v. Wade, Alito said, “the presumption is that the court will follow its prior precedents. There needs to be a special justification for overruling a prior precedent.”
